Abstract

The built environment constitutes a significant asset due to both its ability to contribute to a sustainable energy conversion through energy efficiency measures, and its capacity to reflect different types of cultural values. However, these two specific public interests - that furthermore both constitute sustainability goals - easily collide. This is particularly true regarding windows, with a large part of a building’s heat loss occurring through them. Notwithstanding, windows also constitute a building component of great importance to the building’s aesthetics, architecture and its capacity to reflect cultural values. By focusing on windows measures this study examines whether a sustainable energy conversion is possible without setting the cultural historical, architectural, technical and artistic values at stake. The report analyses the Swedish Plan and Building Act and discusses whether it constitutes a satisfactory instrument for balancing both these interests and sustainability goals and what the main shortcomings in achieving this are. A central finding is that formally, if these two interests collide, there is a stronger protection for cultural values than energy efficiency. Backed up by results from technical and antiquarian research, the report however concludes that it is practically possible to simultaneously achieve both goals. Nevertheless, various problems, both in the legislation as well as in the law application and enforcement currently impede the protection and its intended impact and balance of interests. First, there is a lack of holistic and life-cycle perspectives on sustainability in the Plan and Building Act, which hinders the achievement of long-term sustainability and solutions that benefits both interests. Second, several measures regarding windows never come up to trial. This tendency may increase due to recent case law indicating that window replacements seldomly require building permits because of its limited impact on a building’s appearance. This implicates a weaker protection of cultural values. Third, there is a lack of adequate registry of existing cultural values, a shortage of antiquarian expertise on a municipal level as well as in the responsible judicial courts, deficient municipal supervision, which all add to preventing the formal legal protection of cultural values. Finally, if these deficiencies are mitigated, the report concludes that energy efficiency and the preservation of cultural values do not need to collide, and that window measures may pave the path for both the climate and the preservation of cultural values.
